AVIGDOR’S HELPING HAND 2021 TESLA RAFFLE OFFICIAL RULES & REGULATIONS
The Avigdor’s Helping Hand (“AHH”) Tesla raffle drawing (“Raffle Drawing”) will be held on August 29, 2021. The winner of the Tesla raffle (“Raffle Winner”) may choose to receive either (1) his or her choice of a three year lease of a 2021 Tesla Model Y (hereinafter “Tesla”); or (2) a check in the amount of $20,000.00 (“Cash Prize”).
The pricing of the Tesla is based on its July 2021 pricing. Under no circumstances shall the total amount of the Tesla package exceed $25,500.00 (including taxes, transportation fees, or any other fees whatsoever associated with the lease of the vehicle). The Raffle Winner shall be solely responsible for any and all charges, costs, taxes and fees over and above $25,500.00, including but not limited to costs relating to the purchase and installation of charging equipment.
Rules are subject to change at any time and at AHH’s sole discretion. Winner(s) consent to the use of their names, likenesses and photographs without compensation for publicity purposes to help promote AHH and its programs.
AHH reserves the right to provide the Cash Prize instead of the Tesla lease. If AHH is unable to contact the winner(s) within 28 days of the initial notification then the prize will be deemed unclaimed and a new winner(s) may be drawn, at random.
All entries received after August 29, 2021, 10 p.m. will not be entered into the raffle. The winner(s) will be notified by AHH via email if provided or mail within ten (10) business days of the raffle. It is the purchaser’s obligation to provide AHH with a valid email and/or mailing address. AHH reserves the right at any time, at its sole discretion, to modify or discontinue the raffle with or without prior notice for any reason whatsoever and in such event, a raffle purchaser’s sole and exclusive remedy shall be to receive a refund of the full price paid by such purchaser for each raffle purchased, without interest. The decision of AHH in all matters relating to the Raffle Drawing is final and binding and no correspondence will be entered into.
THE RAFFLE DRAWING AND THESE TERMS AND CONDITIONS WILL BE GOVERNED BY NEW YORK LAW. ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE TESLA RAFFLE OR THESE OFFICIAL RULES SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE BETH DIN OF AMERICA AND CONDUCTED IN NEW YORK.
EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, AHH AND/OR ITS AGENTS, DIRECTORS, EMPLOYEES, OFFICERS OR REPRESENTATIVES ARE NOT MAKING ANY REPRESENTATIONS OR WARRANTIES IN ANY WAY REGARDING THE CONDITION OR FITNESS OF THE TESLA MODEL Y, AND AHH HEREBY DISCLAIMS ALL IMPLIED WARRANTIES WITH RESPECT TO THE TESLA MODEL Y PROVIDED BY AHH PURSUANT TO THIS AGREEMENT, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL AHH AND/OR ITS AGENTS, DIRECTORS, EMPLOYEES, OFFICERS OR REPRESENTATIVES BE LIABLE FOR ANY TYPE OF INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER ARISING INCONTRACT, TORT OR, ANY OTHER CAUSE OF ACTION.
